Terms of service

Upon receipt of payment, the client acknowledges that they are entering into a service agreement with Milk & Stone, recognising that the transaction pertains to services rendered rather than a product purchase. This acknowledgement signifies the clients understanding of the specific terms and conditions governing our service-orientated arrangement.


General terms of service.

1. Application of Terms: These terms and conditions govern all transactions with Milk & Stone, unless explicitly agreed upon in writing by the business owner. This encompasses, but is not restricted to, offers, orders, inquiries, correspondences, and agreements involving Milk & Stone.

2. Exclusive Application: Milk & Stone's terms and conditions hold sole authority in all business interactions, unless expressly consented to in writing.

3. Acceptance of Alternate Terms: Milk & Stone may consider alternative terms and conditions through a written agreement. However, these differing terms and conditions will not bind Milk & Stone unless explicitly agreed to in writing.

4. Order Modifications: Once Milk & Stone receives your inclusions, modifications cannot be accommodated.

5. Ring sizing: Milk & Stone keepsake rings cannot be resized. It is the clients responsibility to accurately obtain their ring size.

6. Non-refundable Deposit: All Milk & Stone orders cancelled within the 24 hour cancellation window are subject to a non-refundable deposit equal to 15% of the total order value excluding shipping costs.

7. Store Credit: Milk & Stone orders can be cancelled in exchange for store credit to the total value of the order if inclusions have not been received. Requests for cancellations made after 24 hours of order placement will only be eligible for store credit if inclusions have not been received.

8. Non-refundable Cancellations: Once inclusions have been received by Milk & Stone, cancellations will not qualify for a refund or store credit. If Milk & Stone does not receive your inclusions within 6 months of order placement, your order will be cancelled and store credit to the value of the order will be issued. Store credit issued under this circumstance will expire 12 months from the date of original order placement. 

9. Client Risk: Clients wear their inclusions at their own risk of loss, theft, damage, or any other unforeseen circumstances. Milk & Stone is not accountable for any loss, theft, damage, or any other unforeseen circumstances. Any loss, theft, damage, or any other unforeseen circumstances (including stone falling out), dose not warrant any form of compensation.

 

Client responsibilities.

1. Clients are solely responsible for sending inclusions to Milk & Stone after order placement.

2. Clients are aware that their order fee does not include postage of their inclusions to our workshop in North Richmond 2754 NSW, Australia. Ignorance of postage costs does not warrant cancellation of their order.

3. Clients are advised not to send the last of any inclusions. Lost mail is often unrecoverable.

4. Clients are responsible for any applicable customs fees or import taxes incurred during the delivery process.

5. Our keepsake rings cannot be resized. Clients are responsible for accurately obtaining their ring size. Any attempts at resizing your ring voids all warranty agreements.

6. Keepsake designs cannot be amended once inclusions have been received. It is the clients responsibility to ensure they have designed their keepsake correctly before ordering.

7. Clients are responsible for accurately selecting their design options from the customization menu. Milk & Stone is not liable for misunderstandings of chosen options, as final selections determine the appearance of the keepsake.

8. Clients are responsible for sending their inclusions in a timely manner. If a design that is ordered is discontinued before Milk & Stone receive inclusions, store credit to the value of the order will be given. In addition, if Milk & Stone does not receive your inclusions within 6 months of order placement, your order will be cancelled and store credit to the value of the order will be issued. Store credit issued under these circumstances will expire 12 months after the date of original purchase.

 

Production & timeframe of orders.

1. Milk & Stone guarantees that the inclusions received for a clients order are the only inclusions used to produce the the product. Upon transfer of funds it is accepted that this can not be proven without destroying the stone.

2. Milk & Stone take extensive precautions to prevent the loss or misplacement of inclusions upon their receipt at Milk & Stone.

3. In the rare event that inclusions are lost after their receipt by Milk & Stone, full transparency is pledged to the client.

4. The production timeframe estimated by Milk & Stone is an approximation. Milk & Stone are not bound by specific dates or deadlines, and are not accountable for any deviations. Any extension in production time does not warrant compensation or alteration of the agreement.

5. The provided production times are based on the regular operations involving multiple stakeholders. While not binding, these estimates are offered in good faith for normal operations.

6. The production time for an order becomes relevant only when an order is placed, paid for, and Milk & Stone have received any inclusions or information necessary to complete the order (including ring sizing, inclusions etc).

7. Milk & Stone considers the production process complete upon order dispatch.

8. In cases where an order comprises multiple items, Milk & Stone reserves the right to hold completed items until the entire order is ready for dispatch. Partial deliveries may incur additional shipping costs, which will be the responsibility of the customer.

9. Given that our products are handmade, slight variations in colour and appearance should be anticipated.

10. Milk & Stone cannot guarantee the colourfastness of your inclusions. It should be anticipated that colour changes such as lightening or darkening may occur when being encased in the stone and over time. These changes are out of our control and do not warrant compensation.

 

Repairs & workmanship warranty.

1. Milk & Stone warrants all jewellery against defects in materials and workmanship for 24 months from the date of delivery.

2. Milk & Stone does not warrant against normal wear and tear, tarnishing, damage caused by accident or failure to follow care instructions.

3. Faults in your keepsake must be reported within 5 business days of receipt. All faults are subject to a review by Milk & Stone before any repair or replacement agreements can be made. If a fault is found Milk & Stone will repair or replace the item at Milk & Stone's discretion.

4. To report a fault please contact Milk & Stone at hello@milkandstone.com.au within 5 business days of receiving your jewellery. Do not wear or use your keepsake(s) once a claim has been submitted.

  • Include relevant photos.
  • Provide a description of the issue.
  • Include proof of purchase.

5. Faults reported after 5 business days may be assessed with considerations for wear and tear, damage caused by accident and/or adherence to care instructions.

 

Non-yellowing guarantee.

1. All Milk & Stone keepsakes purchased on or after 17/11/23 are warranted under our non-yellowing guarantee.

2. Milk & Stone defines yellowing as the discolouration of our stone material in comparison to its original colour. Yellowing is assessed through the clear layer of your stone. Milk & Stone cannot guarantee the colour stability of any materials encased within your stone.

3. If our stone material protected by this policy does turn yellow Milk & Stone will resurface your stone free of charge. A stone turning yellow does not warrant any form of compensation.

4. Conditions not covered under our non-yellowing guarantee: failure to adhere to our care guide, exposure to temperatures over 150°C, contact with harsh chemicals, contact with substances prone to staining such as turmeric, fake tan, hair dye etc.

5. Important note: breastmilk/colostrum that is naturally creamy or yellow may produce a stone that is mildly yellow. This is not classified as yellowing stone. 

 

Milk storage.

1. Any preserved milk not utilised in the production of your order will be securely stored for a minimum period of 24 months, in alignment with our workmanship warranty.

Offers & pricing.

1. Milk & Stone do not host discounted offers or promotions.

2. All prices provided by Milk & Stone include GST. However, charges for insurance, freight, and delivery are applied separately at checkout.

3. Prices may be subject to alteration without notice.

4. Milk & Stone's prices are formulated by taking into account varying factors. These factors encompass metal & gem valuations, currency exchange rates, material expenses, transportation charges, labour costs, taxes, duties, and other decisive cost determinants.

5. In cases where an increase in price occurs after an agreement has been finalised (payment received), the initially agreed-upon price at the time of payment will remain unaffected.

 

Agreements.

1. Milk & Stone considers an agreement has been made when an order and payment have been received.

2. Milk & Stone considers the agreement to be concluded when an order has been dispatched.

3. Statements or agreements made by staff members of Milk & Stone are not deemed legally binding.

You can access the latest version of our Terms of Service on this page at any time. We retain the right, solely at our discretion, to modify, alter, or substitute any portion of these Terms of Service by publishing updates and revisions on our website. It is your responsibility to periodically review our website for any amendments. Your ongoing use of or access to our website or the Service subsequent to the publication of any changes to these Terms of Service indicates your acceptance of those modifications.
